FREDON TOWNSHIP LAND USE BOARD

December 19, 2022

MEMBERS PRESENT:      Andrews, Boland, Boyle, Deitz, Erb, Holenstein, and Lazzaro,

MEMBERS ABSENT:         Conklin, Passafaro, Prommel, Rome, and Wilcox

ALSO PRESENT:                None                                               

Mr. Boland called the meeting to order at 7:00 P. M. with the statement that this meeting is in compliance with the Open Public Meetings Act, Public Law 1975, Chapter 231, Sections 4 and 13, as advertised by Annual Notice in The New Jersey Herald.  If the applicant is a partnership or corporation, an attorney must represent it.  No new applications will be heard after 10:00 P. M.  No new testimony will be heard after 11:00 P. M.

Mr. Boland invited all present to participate in the salute to the flag.

MINUTES

Mr. Boyle moved acceptance of the minutes for the September 19, 2022 meeting as posted and waived reading.  Ms. Erb second.  Roll call vote: In favor: Boyle, Erb, and Boland. Opposed: None.  So moved.

CORRESPONDENCE

As shown on the attached agenda.

RESOLUTIONS

Resolution of the Fredon Township Land Use Board Releasing Funds from Escrow in Accordance with the October 6, 2021 Administrative Consent Order with the New Jersey Department of Environmental Protection

Mr. Boland provided a brief summary of this resolution. Ms. Erb moved to approve this resolution. Ms. Holenstein second. Roll call vote: In favor, Boyle, Deitz, Holenstein, Erb, and Boland. Opposed: None. So moved.

Re-Examination of the Master Plan          

Mr. Boland stated that a committee needed to be established for the re-examination of the Master Plan in 2023. He asked for volunteers. Ms. Erb and Ms. Holenstein agreed to be on the committee.  Mr. Boland said that he would like to have a meeting mid-January and would send out an agenda to the committee. Members of the public will also included in the process.

Land Use Board New Member Application

Mr. Neil McCaffrey submitted a new member application to the Land Use Board.  After a brief discussion, Mr. Boyle made a motion to send Mr. McCaffrey’s application to the Township Committee for review. Ms. Holenstein second. Roll call vote: In favor: Boyle, Deitz, Holenstein, Erb, and Boland. Opposed: None.  So moved.

LIAISON REPORTS

Township Committee

Mr. Deitz stated that he had nothing to report. In response to previous questions from the Township Committee about the Solar and In-Law Suite ordinances, Mr. Boland gave a brief summary of the changes that were recommended by the Land Use Board. He emphasized that in each case, the Land Use Board was attempting to be less restrictive than previous ordinances. Mr. Deitz agreed to discuss the ordinances with the Township Committee.

Environmental Committee

Mr. Boyle stated he had nothing to report.

Mr. Boland opened the meeting to the public. Mr. Ed Potocki, 2 Pine Valley Road, came forward and asked about the correspondence regarding Bear Brook. Mr. Boland explained that the email was in reference to the release of escrow funds and provided Mr. Potocki a copy of the correspondence and resolution relating to it.

Mr. Andrews arrived at 7:13 pm

Mr. Jim Weber, 14 Hillview Road, came forward and stated that he continues to be concerned about the short term rental in his neighborhood. He indicated that there are no current issues, but he is hoping that the Township Committee comes up with a solution before issues return. There was a brief discussion about the positive and negative impact of short term rentals. Mr. Deitz will follow up with the Township Committee on how to move forward.

Mr. Lazzaro arrived at 7:15 pm

Mr. Boland stated that he would like to have one more member on the committee for the re-examination of the Master Plan. Mr. Lazzaro volunteered.

There being no further business before the Board, a motion was made to adjourn at 7:20 P. M.  All in favor.  So moved.
