FREDON TOWNSHIP LAND USE BOARD

Special Meeting

July 26, 2021

MEMBERS PRESENT:                   Andrews, Boland, Boyle, Conklin, Erb, Holenstein, Passafaro, Rome, and Wilcox

MEMBERS ABSENT:                     Lazzaro, Prommel, and Richardson

ALSO PRESENT:                             Mr. Robert Correale, Esq.                                                               

Mr. Boland called the meeting to order at 7:30 P. M. with the statement that this meeting is in compliance with the Open Public Meetings Act, Public Law 1975, Chapter 231, Sections 4 and 13, as advertised by Special Notice. 

Mr. Boland invited all present to participate in the salute to the flag.

Mr. Boland introduced Mr. Brady’s partner, Mr. Robert Correale. He was in attendance in place of Mr. Brady who was unable to attend the meeting.

MINUTES

Ms. Holenstein moved acceptance of the minutes for the January 27, 2021 meeting as posted and waived reading.  Mr. Boyle second.  Roll call vote: In favor Boyle, Holenstein, Erb, Passafaro, Andrews, and Boland.  Opposed: None. So moved.

OTHER BUSINESS

Ordinance No. 2021-08 - An Ordinance Prohibiting the Operation of Any Class of Cannabis Businesses Within the Geographical Boundaries of the Township of Fredon and Amending Article V Entitled “General Regulations” of the Township Code to Include New Section 550-43 Pertaining To Same

Mr. Boland gave a brief summary of the cannabis ordinance introduced by the Fredon Township Committee. He stated that due to insufficient guidance from the State at this time, the Township Committee wants to prohibit cannabis businesses now, but may re-visit the topic when more information is available. Mr. Correale stated that if an ordinance prohibiting it is not passed by the

August 22, 2021deadline, the Town is precluded from doing anything for 5 years, and must allow all classes of cannabis businesses to operate. Mr. Correale stated that cannabis businesses would be allowed as a “conditional use”, but the State has not identified any conditions yet. A discussion was held regarding the advantage of passing an ordinance prohibiting cannabis businesses now, with the possibility of changing it at a later date.

Ms. Holenstein made a motion to recommend to the Township Committee that Ordinance 2021-08 be approved and enacted. Mr. Andrews second. Roll call vote: In favor: Boyle, Holenstein, Rome, Wilcox, Erb, Conklin, Passafaro, Andrews, and Boland. Opposed: None. So moved.

EXECUTIVE SESSION

Upon motion by Mr. Rome, with second by Ms. Holenstein, the Board entered into Executive Session at 7:40 P.M. Upon motion by Ms. Holenstein, with second by Mr. Rome, a motion to exit the Executive Session at 7:50 P.M.was made. All in favor. So moved.

Chairman Boland announced a matter regarding litigation was discussed and no decisions were made.

Resolution of the Fredon Township Land Use Board Approving Administrative Consent Order with the New Jersey Department of Environmental Protection

Mr. Rome made a motion to approve the Resolution of the Fredon Township Land Use Board Approving Administrative Consent Order with the New Jersey Department of Environmental Protection. Ms. Holenstein second. Roll call vote: In favor: Boyle, Holenstein, Rome, Erb, Conklin, Passafaro, Andrews, and Boland. Abstain: Wilcox. Opposed: None. So moved.

There being no further business before the Board, a motion was made to adjourn at 8:00 P. M.  All in favor.  So moved.
